Independent Mental Health Advocate (IMHA)

An Independent Mental Health Advocate (IMHA) is an Advocacy role and duty created under the Mental Health Act 1983.

Most people detained under section, subject to a Guardianship Order or a Community Treatment Order are entitled to an IMHA.

IMHA’s are independent and can support people to understand and manage their circumstances, understand the law and know their rights and represent their views about proposed treatment.

If a person is already receiving support from an IMHA and becomes eligible for advocacy support in relation to the Care Act (including safeguarding), consideration should be given for the IMHA to fulfil this advocacy role as well.
