Managing Authority (DoLS)

Under the Deprivation of Liberty Safeguards the managing authority is the setting in which the person is being deprived of their liberty. Where the managing authority suspects a person to be deprived they must approach the Supervisory Body (normally the Local Authority) to authorise the deprivation. Failure to do so is a direct breach of Article 5 of the European Convention on Human Rights (ECHR) and a criminal offense.

When a deprivation is authorised the role of the managing authority is to alert the Supervisory body should the DoLs no longer be effective or required, and to request a review of the DoLS when the authorisation period is approaching expiry.
