Supervisory Body (DoLS)

Under the Deprivation of Liberty Safeguards the Supervisory Body (usually the Local Authority) is responsible for managing the response to a request for authorisation made by a Managing Authority (the setting where the person is being deprived), co-ordinating or completing the Deprivation of Liberty Safeguards Assessments, authorising the Deprivation, agreeing any conditions, monitoring any conditions and undertaking a review of the deprivation.

It is the role of the Managing Authority to notify the Supervisory Body of a deprivation, the need to review a deprivation or the need to consider revoking a deprivation. However, where a Supervisory Body is aware that an unauthorised or unnecessary deprivation is occurring they have a moral duty to take action to ensure that the person’s rights under Article 5 of the European Convention of Human Rights (ECHR) are not breeched.
